1. Agreement to Terms

By accessing or using Optly (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

Optly is a product of Awakyn Labs (“Company,” “we,” “us,” or “our”).

2. Description of the Service

Optly provides tools intended to help users identify publicly available personal information associated with their name on certain data broker and people-search websites, and to assist with opt-out or removal requests where available.

The Service includes a free scan feature and paid plans that may include monitoring, opt-out assistance, and related features.

3. Eligibility

You must be at least 18 years old to use the Service. By using Optly, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Accounts

Some features may require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to update it as needed.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to scan or remove information about another person without proper authority
  • Abuse, overload, or interfere with the Service or its infrastructure
  • Reverse engineer, scrape, or attempt to extract non-public data from the Service in an unauthorized manner
  • Misrepresent your identity or affiliation
  • Use the Service to harass, harm, or violate the rights of others

6. Scans and Results

Scan results are based on publicly available information and automated processes. Results may be incomplete, outdated, or inaccurate. Optly does not guarantee that all listings will be found or that any particular removal request will be successful.

Data brokers and people-search sites control their own databases and opt-out processes. Some sites may require additional verification, may refuse requests, or may re-list information later.

7. Paid Plans and Billing

Paid plans are billed according to the pricing displayed at the time of purchase. Payments are processed by Stripe. By purchasing a plan, you authorize us (and Stripe) to charge the applicable fees.

  • Monthly / Yearly plans renew automatically unless canceled
  • Lifetime plan is a one-time payment for ongoing access to the then-current Service features included in that plan
  • You may cancel a subscription at any time; access continues until the end of the current billing period

Fees are generally non-refundable except where required by law or explicitly stated otherwise.

8. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by Awakyn Labs or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that scan results or removal efforts will be complete or successful.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAKYN LABS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Awakyn Labs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time.

13. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be reflected by an updated “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Wisconsin, unless applicable law requires otherwise.
